LEGAL DISCLAIMER
- Scope: This disclaimer (“Disclaimer”) applies to the mini packages (“Packages”) offered by Elite Virtual Assistants to its potential clients (“Clients”) and the virtual assistants (“VAs”) serving them.
- Duration: The timeframe for the completion of each Package is 30 days, commencing on the date of the initial consultation.
- Meeting Time Allocation: Included within each Package is one full hour of direct meeting time with the assigned VA. This hour is divided into three primary consultations: a. The first 30 minutes are dedicated to gathering pertinent information. b. A subsequent 15-minute consultation, scheduled mid-project, for progress assessment. c. A final 15-minute consultation to review and confirm package completion. Client may waive their right to a mid point or end of project meeting or replace said meeting with email correspondence.
- Non-refundable: Packages are non-refundable. Once purchased, Clients are not entitled to a refund for any reason.
- Forfeiture of Project: Projects not finalized within 30 days due to Client’s unavailability for consultations or review are deemed forfeited. Issues arising from the VA’s end will be individually reviewed, with a potential reassignment of a new VA for completion.
- Limitation of Liability: Elite Virtual Assistants, its affiliates, representatives, and employees shall not be liable for any losses, damages, or claims arising from the Packages, including but not limited to, direct, indirect, incidental, punitive, and consequential damages.
- Indemnification: The Client agrees to indemnify, defend, and hold harmless Elite Virtual Assistants from any losses, expenses, damages, and costs, including attorneys’ fees, resulting from any violation of this Disclaimer or any activity related to their account.
- Warranties Disclaimer: Elite Virtual Assistants offers no warranties, expressed or implied, and disclaims all other warranties, including, without limitation, implied conditions of merchantability or fitness for a particular purpose.
- Force Majeure: Neither party will be responsible for any failure or delay in its performance under this agreement due to causes beyond its reasonable control.
- Entire Agreement/Severability: This Disclaimer supersedes all previous agreements, understandings, and representations related to the Packages. If any provision is deemed unenforceable, it shall be limited or eliminated to the minimum extent necessary, ensuring the Disclaimer remains in full force.
- Governing Law and Jurisdiction: Governed by the laws of Cleveland, Ohio, USA, both parties submit to the exclusive jurisdiction of these courts.
- Amendments: Elite Virtual Assistants may modify this Disclaimer at any time. Changes will be posted here, and Clients and VAs should review regularly.
- No Waiver: No waiver by Elite Virtual Assistants of any breach or default by the Client shall act as a waiver of any preceding or subsequent breach or default.
- Acknowledgment: By engaging in a Package, both Client and VA acknowledge understanding and agreement to the terms in this Disclaimer.
- Work Commitment and Additional Hours: The VA will endeavor to complete as much work as possible within the stipulated time frame of the Packages. Should the Client wish to procure additional hours beyond the Package’s scope, they have the option to:
- Purchase an additional Package.
- Be billed at an hourly rate of $47/hour.
